Potholes cause misery for drivers every day of the week across the country, and they are only getting worse.
The 'P' word has become a hot issue for drivers in the UK and has been covered extensively in newspapers and various television programmes, including Pothole Britain, which you can watch here.
So what should you do if your car has been damaged by the curse of potholes?
Well, you can claim for compensation from the local authority. However, your chances of success may depend on whether the pothole has been reported previously. If the council can show that it has taken reasonable care to 'ensure that the part of the road/highway to which the action relates was not dangerous to traffic’, it may have a legal defence.
But, if you can show that the council or Highway Agency knew about the pothole but didn’t repair it, or didn't follow road maintenance guidelines, you may be entitled to compensation.

3. Get details and witness statements [if available]
4. Report the pothole
5. Make your claim

7. Be willing to negotiate
8. Stay patient and keep copies of correspondence
Hopefully if you follow these steps, you'll be able to receive compensation for any car damage you suffer. But failing that, you can claim via your car insurance. Pothole damage will be covered if you have comprehensive insurance, but claiming may affect your no-claims discount so check with your individual insurer.
